What You Need to Know About Hiring a Lawyer in Chicago

Chicago is the legal center of the Midwest. The city has a proud tradition of aggressive trial lawyering, and the Cook County court system is one of the largest and most active in the United States. If you need a lawyer in Chicago, you have access to some of the best in the country — but you need to know how to find the right one.

The Cook County Court System

Cook County has one of the busiest court systems in the country. The Circuit Court of Cook County handles most civil and criminal matters. There are several divisions: the Law Division handles larger civil cases including personal injury; the Chancery Division handles equity matters including some family law disputes; the Domestic Relations Division handles divorce, custody, and support; and the Criminal Division handles felony charges. The Daley Center downtown is the main courthouse, but there are also six suburban district courthouses serving different parts of the county.

Illinois Divorce Law

Illinois is an equitable distribution state that eliminated fault-based divorce in 2016. All divorces are now no-fault — you simply allege "irreconcilable differences." Property earned or acquired during the marriage is marital property divided equitably (not necessarily equally). Factors include the duration of the marriage, each spouse's contributions, economic circumstances, and tax consequences. Spousal maintenance (alimony) is calculated using a statutory formula for marriages under 20 years, with judicial discretion for longer ones.

Personal Injury Law in Illinois

Illinois follows "modified comparative fault" with a 51% bar — meaning you cannot recover if you're 51% or more at fault. If you're 50% or less at fault, you recover your damages reduced by your percentage. The statute of limitations for personal injury is generally 2 years from the date of injury. For medical malpractice, it's 2 years from discovery (but no more than 4 years from the act). Wrongful death claims must be filed within 2 years of death. Chicago's legal market has a strong tradition of plaintiff representation, and contingency fee cases are common.

Bankruptcy in Illinois

Illinois bankruptcy cases are filed in the Northern District of Illinois (Chicago), the Central District, or the Southern District depending on location. Chicago has one of the most active bankruptcy courts in the Midwest. Chapter 7 (liquidation, for those with limited income) typically resolves in 3–6 months. Chapter 13 (reorganization, for those with regular income who want to keep assets) takes 3–5 years. Illinois allows debtors to choose between state and federal exemptions — an attorney can advise which is more favorable in your situation.

What Does a Chicago Lawyer Cost?

Chicago attorney rates are lower than New York and Los Angeles but still significant. Solo practitioners and small boutique firms: $200–$350/hour. Mid-size firms with strong track records: $300–$450/hour. Large firm partners: $500–$900/hour. Personal injury, employment discrimination, wrongful death, and workers' comp cases are routinely handled on contingency — no upfront cost. Many family law and criminal defense attorneys offer payment plans.
